End User License Agreement (EULA)


 

for the Atlassian Marketplace App “Incident Reports for Jira”

This End User License Agreement (“Agreement”) is a legal agreement between you (“Customer” or “You”) and Hawatel, a company incorporated in Poland (“Company”), governing your use of the software application Incident Reports for Jira (“App”) made available via the Atlassian Marketplace.

By installing, accessing, or using the App, You agree to be bound by this Agreement and the Atlassian Marketplace Terms of Use. If You do not agree to these terms, do not install or use the App.

 

1. Definitions

  • “App” means the software application “Incident Reports for Jira” developed and provided by the Company.
  • “Company” means Hawatel, a Polish software vendor.
  • “Customer” means the individual or legal entity that installs or uses the App.
  • “Services” means any features, functions, or support provided by the Company in connection with the App.
  • “Atlassian Product” means Jira Cloud or any other Atlassian product with which the App is used.

 

2. License Grant

Subject to the terms of this Agreement, Company grants Customer a limited, non-exclusive, non-transferable, and revocable license to use the App within Atlassian’s Cloud environment for Customer’s internal business purposes during an active subscription period.

 

3. Restrictions

Customer shall not, directly or indirectly:

  • reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the App;
  • modify or create derivative works based on the App;
  • use the App for service bureau or resale purposes;
  • remove or obscure any proprietary notices or labels on the App;
  • use the App in violation of applicable laws or Atlassian’s Terms of Service.

 

4. Data Handling and Privacy

The App accesses Jira project data using Atlassian’s public APIs to generate and export issue reports. The App allows users to import and manage their own Word templates, which are securely stored within Atlassian Forge Storage — Atlassian’s native, isolated cloud storage environment.

Imported templates are associated only with the specific Jira Cloud instance where the App is installed. They are not transferred or accessible outside the Atlassian Cloud infrastructure. The App does not collect, transmit, or store any other user or issue data beyond what is required to render and export reports.

All template data stored in Forge Storage is managed in compliance with Atlassian’s data security and privacy standards. For additional details about how the Company handles data, please refer to its Privacy Policy (if applicable).

 

5. Support

During an active subscription, the Company will provide reasonable technical support regarding the operation and functionality of the App via the contact channels listed on its Atlassian Marketplace page. Support does not include training, configuration of Jira instances, or custom report development unless otherwise agreed in writing.

 

6. Warranties and Disclaimer

The App and related Services are provided on an “AS IS” and “AS AVAILABLE” basis. Except as expressly provided in this Agreement, the Company disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the App will be uninterrupted, error-free, or meet Customer’s specific requirements.

 

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its officers, affiliates, and contractors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or in connection with the use or inability to use the App. In no event shall the Company’s total liability exceed the fees paid by the Customer for the App in the twelve (12) months preceding the event giving rise to such liability.

 

8. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to all intellectual property rights, remain with the Company. Nothing in this Agreement shall transfer ownership of any intellectual property to the Customer.

 

9. Termination

This Agreement and the license granted herein automatically terminate upon expiration of the subscription or if the Customer breaches any term of this Agreement. Upon termination, the Customer shall cease all use of the App.

 

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Warsaw, Poland.

 

11. Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the App and supersedes all prior communications, proposals, or agreements, whether oral or written. Any modifications to this Agreement must be made in writing and signed by both parties.
